Vehicle Inheritance
The information below is required when transferring ownership of a vehicle due to inheritance. In most cases, there are three scenarios in which a vehicle can be inherited through the following:
- Probated Will
- Non-Probated Will
- No Will
Probated Will:
The inheritor can sell the vehicle directly to a buyer. The inheritor will simply sign the title as seller on the back of the title and provide the buyer with the title and a certified copy of one of the following:
- Notarized Letter of Testamentary
- Notarized permanent letters of administration
- Approved Year’s Support application, which gives complete description of the vehicle including year, make, model, and vehicle identification number
If the inheritor would like to title the vehicle in their name, they would need the following:
- Georgia or out of state title
- Georgia driver’s license or ID card
- One of the following documents:
- Notarized Letter of Testamentary
- Approved Year’s Support application, which gives complete description of the vehicle including: year, make, model, and vehicle identification number
Non-Probated Will:
An inheritor cannot sell an inherited vehicle with a non-probated will without first putting the title into their name. To get the title in the inheritor’s name, the following documents are required:
- Georgia or out of state title
- Georgia driver’s license or ID card
- Copy of non-probated will
- T-20 affidavit of inheritance
- Certified copy of death certificate
No Will:
To title a vehicle whereby the deceased left no will, the inheritor must first title the inherited vehicle into their name. To do so, the following documents are required:
- Georgia or out of state title
- Georgia driver’s license or ID card
- Copy of non-probated will
- T-20 affidavit of inheritance
- Certified copy of death certificate
In all circumstances above, to register or “tag” the vehicle, additional requirements are as follows:
